Prohibited Usage of Items

Custom Scene Unlimited single license allows you to use items for most purposes. However, there are some uses which we do not allow. Below is a non-exhaustive summary of what you cannot use downloaded items.

Summary of Prohibited Usage

  • No Redistribution of Items, Even With Modifications: Items on Custom Scene cannot be redistributed as-is (whether for free or paid) as stock, in tools or templates or with source files. You can modify them for your own use, but cannot redistribute the items themselves, even in a different form. You can't redistribute the item on its own or bundled with other items, even with superficial modifications.
  • You Cannot Use Items in On-Demand, Made to Order or Build Yourself Applications: Items on the Custom Scene cannot be offered in on-demand services (such as a site where a customer customizes a design of a t-shirt for order). Whether the end result is a digital or physical product, this use is prohibited.
  • No Use in Merchandising Where the Main Value is the Item Itself: You cannot use an item as merchandise, such as a frame mockup, so long as it is the main value of the product. You can use items in merchandising, if they are incorporated into a larger end product and/or significantly altered.
  • Items Incorporated Into End-Products Cannot be Extracted or Used Separately: You cannot extract or use individual components outside of the end product. You must take all necessary steps to prevent this happening and inform clients of their responsibility.
  • No Trademark or Service Mark Rights for Items Included Within the End Product: The trademark law doesn't allow you to claim trademark rights for any materials that are included in the end product. They must be excluded from any trademarks or service marks for the end product.
  • One Account = One User: No Sharing of Details or Items: Your account is not allowed to be shared with any other person, even those within the same organization. Items installed (such as fonts) can only be accessed by you (the subscriber). You cannot transfer downloaded items to another user.
  •  Usage of Items on Two Devices Only & With an Active Subscription: In case you need to download or use one of the items, you can use each item on up to two devices. You need to have an active Custom Scene subscription in order for it to work.
  • Items Can Only be Used for Lawful Purposes: The items you use can't be used for anything illegal or questionable. These items may not be used in any materials that are offensive, defamatory, pornographic, obscene, or demeaning to anyone else. You can’t use items in a way that creates a fake identity, implies personal endorsement of a product by the person, or in connection with sensitive subjects.
  • You Cannot Claim Ownership of an Item, Even When Included in an End Product: Custom Scene remains the copyright holder of all Items. We cannot transfer ownership of any Item which has been modified, even if it is one that you created.

Correct Usage of Items

Custom Scene Unlimited single license gives you the confidence that items that you download can be used in most projects and applications, including commercial usage. To find out more about the exact restrictions on how these assets can be used, read the licensing guidelines.

Summary of Correct Usage

  • Active Subscription: In order to use any items you've downloaded from Custom Scene for new projects, you must have an active subscription.
  • Unlimited Usage: Items downloaded from Custom Scene are licensed for unlimited use. You can use the same item in multiple projects, but must have an active subscription to use it.
  • Items Must be Customized or Incorporated Into a Larger Project: The items should be incorporated into a larger project or customized in a way that requires some level of skill and effort (eg: you cannot redistribute an item 'as-is').
  • Public Display, Reproduction or Communication is Allowed: This license allows you to put items that have been used in a public display, communicated, broadcast, distributed or reproduced as long as they have been customized or made part of another larger project.
  • Unlimited Copies & Distribution of an End Product: There is no limit to the number of copies you can make of your end product (eg: you could present your product incorporating an item an unlimited number of times). You can distribute these end products in any and all media formats.
  • End Products Using Items can be Transferred to a Client (sublicensing): Where you have created an end product for a client, you are permitted to transfer the entire end product to the client (with a limited sublicense of the item rights as part of this). When you do this, you must have an active subscription at the point of transfer, must ensure the item cannot be extracted from the end product and you must inform the client of their obligations.
